Why Is Filing a Petition for Probate Crucial?

The petition for probate is the official document that kicks off the entire process. Think of it as the opening move in a carefully choreographed legal dance. It’s filed with the court and outlines key information like the decedent’s name, date of death, and the estimated value of their estate.
This petition also requests that the court appoint you, or another suitable individual, as the executor or administrator of the estate. This person will then be responsible for managing all aspects of probate, from gathering assets to paying debts and ultimately distributing the remaining property to the rightful heirs.
Ordinarily, you’ll need to submit the original will, if one exists, along with the petition. The court reviews these documents carefully to ensure everything is in order before proceeding. Without a properly filed petition, the probate process simply cannot begin.

That sounds like a very important step. Have you ever encountered any difficulties during this stage of probate?
Steve Bliss:
There have been times when locating a valid will proved challenging. Once, I represented a family who believed their father had left behind a detailed will outlining his wishes. After extensive searching, we discovered he’d actually created several drafts over the years but never finalized one.
Consequently, we had to proceed as if there was no will, which meant following intestate succession laws to determine how the estate should be divided. It was a complex situation that underscored the importance of clearly communicating your wishes and ensuring your final will is properly executed and stored.
In another case, a family member tried to contest the validity of the will. This added significant time and expense to the process. Thankfully, we were able to successfully defend the will’s authenticity through evidence and testimony.

My best advice is to seek professional guidance from an experienced probate attorney as soon as possible. The probate process can be intricate and emotionally taxing.
