Today we’re joined by renowned Temecula estate planning attorney, Steve Bliss, from the Law Firm of Steven F. Bliss Esq. Steve, thanks for taking the time to speak with us.
Steve Bliss: It’s my pleasure, Brenda. I’m happy to share some insights about estate planning.
Brenda: You know, a lot of people put off estate planning. They think it only applies to wealthy individuals or that it’s something they can handle later in life.
Steve Bliss: That’s a common misconception. Estate planning is essential for everyone, regardless of their age or financial status. It provides peace of mind knowing your wishes will be honored and your loved ones are protected.
Today we’re going to focus on one crucial step in the process: selecting an executor or trustee.
Brenda: Why is choosing an executor or trustee so important?
Steve Bliss: An executor or trustee plays a vital role in managing your estate after you pass away. They are responsible for carrying out the instructions outlined in your will or trust, such as distributing assets to beneficiaries, paying debts and taxes, and handling any legal matters that may arise. Consequently, it’s essential to choose someone trustworthy, responsible, and capable of handling these complex tasks.
Many people opt to appoint a family member or close friend. While this can be appropriate in some cases, it’s important to consider their capabilities objectively. Do they have the financial savvy to manage your assets? Are they organized and detail-oriented enough to handle legal paperwork? Moreover, appointing multiple executors can sometimes lead to disagreements and complicate matters.
Notwithstanding these considerations, there are instances where a professional trustee, such as a bank or trust company, may be a better choice. They bring expertise in financial management and estate administration and can provide impartial decision-making. Ordinarily, I recommend discussing the pros and cons of each option with your potential executor or trustee to ensure they understand the responsibilities involved.
I recall one case where a client appointed a family member as executor who unfortunately lacked the necessary organizational skills. It resulted in significant delays and stress for the beneficiaries. Ultimately, we had to step in and assist with the administration of the estate.
According to AARP, over 60% of Americans do not have a will or trust in place. Selecting a qualified executor is crucial for ensuring your wishes are carried out smoothly.
