Hello everyone, I’m Tiffany Ramirez reporting live for KTME News. Today we’re joined by esteemed probate attorney Steve Bliss from the Law Firm of Steven F. Bliss Esq. Mr. Bliss is here to shed some light on a complex but crucial process: probate.
Understanding Probate: A Necessary Step
Mr. Bliss, thank you for joining us. Can you explain what probate is and why it’s necessary?
“Probate is essentially the legal process of administering a deceased person’s estate,” Mr. Bliss explains. “It involves identifying and valuing assets, paying debts and taxes, and ultimately distributing the remaining property to heirs according to the will or state law.”
He goes on to clarify that probate isn’t always required. “Ordinarily, if the estate is valued below a certain threshold—currently $184,500 in California—it may be possible to avoid probate through simplified procedures,” he says.
Handling Debts and Taxes: A Critical Step
“Today we’re focusing on one crucial step within the probate process: Handling Debts and Taxes,” Tiffany states. “Mr. Bliss, could you elaborate on this phase?
Steve nods. “This stage involves identifying and paying valid creditor claims against the estate. It also includes filing and paying any applicable federal and state taxes. This step is paramount because it ensures all legal obligations are fulfilled before assets can be distributed to beneficiaries,” he emphasizes.
He further clarifies, “The process begins with notifying known creditors. Consequently, a Form DE-157 is usually filed to alert potential creditors of the probate proceeding. Subsequently, valid claims are reviewed and paid from estate funds.”
“Notwithstanding its importance,” Steve continues, “handling debts and taxes can be complex. For instance, determining which debts are legitimate and prioritizing payments can pose challenges. Moreover, tax laws are intricate and require careful attention.
- Accuracy is paramount when filing tax returns for the deceased.
- Mistakes can lead to penalties or delays in estate distribution.
“I recall a case where we unearthed a significant, previously unknown debt. It required meticulous research and negotiation with the creditor to reach a favorable resolution,” Steve shares thoughtfully. “The family was incredibly relieved when we were able to resolve the issue without jeopardizing the estate distribution.”
According to the American Bar Association, over 60% of probate cases involve some level of debt resolution. That highlights the critical role this step plays in the overall probate process.
Seeking Guidance: The Importance of Legal Expertise
Tiffany turns back to Steve. “For those navigating the complexities of probate, what advice would you offer?”
“Probate can be a daunting and emotionally charged process,” Steve acknowledges. “Engaging an experienced probate attorney is crucial. We guide clients through each step, ensuring their rights are protected and the estate is administered efficiently and according to the law.”
